WILLIAMS UNIFORM COMPLAINT PROCEDURES
Notice to Parents, Guardians, Pupils, and Teachers Complaint Rights

Pursuant to California Education Code Section 35186, you are hereby notified that:

  1. There should be sufficient textbooks and instructional materials. That means each pupil, including English learners, must have a textbook or instructional materials, or both, to use in class and to take home.
     
  2. School facilities must be clean, safe, and maintained in good repair.
     
  3. There should be a teacher assigned to each class and not a series of substitutes or other temporary teachers. The teacher should have the proper credential to teach the class, including the certification required to teach English learners if present. There should be no teacher vacancies or misassignments.

    Teacher vacancy means a position to which a single designated certificated employee has not been assigned at the beginning of the year for an entire year or, if the position is for a one-semester course, a position to which a single designated certificated employee has not been assigned at the beginning of a semester for an entire semester.
     
    Misassignment means the placement of a certificated employee in a teaching or services position for which the employee does not hold a legally recognized certificate or credential or the placement of a certificated employee in a teaching or services position that the employee is not otherwise authorized by statute to hold.
     
  4. To file a complaint regarding the above matters, obtain a complaint form at the school office or the Livermore Valley Joint Unified School District Office at 1040 Florence Rd., Livermore, Ca 94551.

(Q) What is the intent of the Williams Settlement Legislation?

To ensure all pupils have equal access to: instructional materials, qualified teachers, and safe, clean, adequate facilities.

(Q) Where can we view the Williams Uniform Complaint Procedures?

Per California Education Code, they are posted in every classroom in the District.

(Q) Did LVJUSD receive any uniform complaints in the Williams Settlement areas in 2004-05?

No

(Q) Did LVJUSD receive any uniform complaints in the Williams Settlement areas in 2005-06?

No

(Q) Did LVJUSD receive any uniform complaints in the Williams Settlement areas in 2006-07?

No. The LVJUSD has not received any complaints under the Williams Settlement legislation terms since its inception.

(Q) Have any Livermore Valley Joint Unified School District sites been visited and reviewed for compliance according to the Williams Settlement terms?

No. LVJUSD schools have not been visited, as there have been no complaints filed.

(Q) Are (in 2007-08) any Livermore Valley Joint Unified School District sites going to be visited and reviewed for compliance according to the Williams Settlement terms?

Two schools, Marylin and Portola Elementary Schools, will be visited in September 2007.

(Q) Why are Marylin and Portola chosen and scheduled for a visit?

Marylin and Portola were selected for a visit because they were ranked in Decile 1, 2, or 3 according to the State Academic Performance Index. Neither school has received a complaint, yet they will be visited.
